Bayfront Floral & Event Design Standard Terms & Conditions

For and in consideration of Bayfront Floral & Event Design providing goods and services to the Client, the following terms and conditions shall apply.

1. Client shall pay the balance due on this agreement not less than fourteen (14) days prior to the scheduled event. Clients agree that, at the request of Bayfront Floral & Event Design, Client shall pay by cash or Personal Bank Check. Client shall NOT be entitled to request or demand a refund of amounts paid or any other accommodation under this agreement following the date of the event to be celebrated. NO EXCEPTIONS!

2. In the event the Client cancels, repudiates, or otherwise breaks this agreement for any reason whatsoever, including but not limited to the postponement or cancellation of the event to be celebrated, any deposits and/or prior payments made by the Client under this agreement shall not be refundable or returnable and shall belong to and be retained by Bayfront Floral & Event Design.
Bayfront Floral & Event Design’s damages shall in no event be deemed less than the amount of such payment(s) on account, and the retention thereof shall not relieve Client of any additional liability to Bayfront Floral & Event Design for its loss of profit under this agreement, regardless of the reason for cancellation. In that the amount of actual loss is difficult to determine, any sum forfeited by the Client under this agreement shall be considered liquidated damages and shall not be considered a penalty.

3. If this agreement pertains to an event being held outdoors, this agreement shall be binding and in full force and effect irrespective of inclement weather conditions on the day of the event. Bayfront Floral & Event Design reserves the sole and exclusive right to determine whether it shall be capable of performing under this agreement due to inclement weather conditions, and in the event that Bayfront Floral & Event Design is unable to perform, no liability shall accrue to Bayfront Floral & Event Design.

4. Bayfront Floral & Event Design shall have the right to make substitutions in the floral or other items that are not reasonably or readily obtainable in the open market, subject to reasonable prior notice to the Client and as mutually agreed.

5. Client shall be responsible for and shall reimburse Bayfront Floral & Event Design for any and all damage to Bayfront Floral & Event Design’s equipment (including trees, linens, vases, centerpieces, stands, pedestals, lighting equipment, chair covers, glassware, etc.) caused by Client, Client’s guests, employees, invitees, or any other persons attending the event.
The Client will also be responsible for and shall reimburse Bayfront Floral & Event Design for any and all equipment that is not returned at the conclusion of the event, including vases, centerpieces, stands, pedestals, trees, linens, chair covers, and lighting equipment, etc. These items are the property of Bayfront Floral & Event Design and must either be reimbursed or returned within seven (7) days after the event.

6. Bayfront Floral & Event Design shall have no responsibility or liability to supply any service or otherwise comply with the terms and conditions of this agreement when prevented from doing so by an event of force majeure, including but not limited to acts of God, strikes, labor disputes, riots, rebellion, war, terrorism, sabotage, fires, floods, explosions, accidents, inability to procure materials or labor after diligent efforts, or any other cause beyond Bayfront Floral & Event Design’s reasonable control, or by orders or regulations of any governmental authority, or failure of fuel supply, water, gas, electricity, air conditioning, or any other facility or utility.

7. In the event that a legal or collection action arises from this agreement, venue and jurisdiction shall be in Dade County, Florida, and the prevailing party shall be entitled to an award of its attorney’s fees and costs incurred, including those incurred at the appellate level and/or costs of collection.

8. Bayfront Floral & Event Design shall have the right to photograph all or parts of the event. Such photographs and recordings are the sole property of Bayfront Floral & Event Design, and consent is given to use such photographs for the purpose of marketing and promoting Bayfront Floral & Event Design services to other prospective clients.

9. In the event that the reception ends after 12:00 AM, there will be an additional $500.00 labor fee.

10. If the event goes past the original end time listed in the proposal, there will be a $250.00 labor fee per hour.

11. If the Client requests to leave any ceremony florals up after the proposed ceremony end time listed, there will be an additional $250.00 fee unless previously discussed.
